General terms of conditions
Article 1: Identity webshop
The webshop TrotDirect, a business with registered office at Deerlijkseweg 68, 8790 Waregem, Belgium, VAT BE00642.805.439 offers its customers the opportunity to buy online.
The present general conditions apply to all products from the "TrotDirect" range and any purchase by the customer places on www.trotdirect.com.
The customer that accepts these terms and conditions shall apply to the exclusion of his own general or specific (purchase) conditions , even if they would stipulate that they apply only on his apply.
Article 2 : Price & Extra cost
All prices are always inclusive of VAT and all other taxes are required to be carried by the customer. If transport, booking or administrative fees are charged they are specifically highlighted. The indication of price refers only to items as described verbatim. The accompanying photo is decoratively designed and may contain items that are not included in the price.
If the weight or size of the ordered products are over 50kg or 50cm x50 cm x 50cm we will have to send true pallet and therefore there is another cost.
Article 3: Offers
Each offer is only open to customers who are resident in the European Union. The articles are intended solely for normal residential use. Despite the fact that the catalog and website has been compiled with the utmost care, it is possible that the information provided is incomplete, contains material errors, or not up-to -date. If you have specific questions about eg availability , delivery method or delivery , please contact our customer service.
TROTDIRECT is what the correctness or completeness of the information provided only held to an obligation of means. TROTDIRECT is in no way liable in the event of material errors , misprints or typographical errors. The offer is valid while stocks last and may at any time be changed or withdrawn. Article 4: Purchases
The customer has the option to buy the items from TrotDirect's catalog online. The acquisition is concluded at the moment the customer receives a confirmation email from TrotDirect. The items will be home delivered to the customer on the delivery date specified in the confirmation email .
The customer can choose between the following payment methods :
- by debit card
- by credit card
- via bank transfer ( The articles are sent from the time the payment is received by us. If after 7 days payment has not been received , the order will be canceled automatically .
In some cases an extra cost can be added for transportation, the extra cost will be transmitted to the customer and will only be sent when cost is paid.
Article 5: Retention of title
The delivered goods remain until the date of full payment by the customer , the exclusive property of TrotDirect . The risk of loss or damage , however, goes to the customer from delivery. The customer agrees to the retention of TrotDirect.
Article 6: Penalties for non-payment
Without prejudice to the exercise of any other rights TrotDirect offers , the customer in the event of non - payment or late payment from the date of the breach of law and without notice, an interest of 12 % per annum on the unpaid amount . Moreover, the customer shall automatically and without notice and a compensation of 12% of the relevant amount , with a minimum of 50 euro per invoice . Notwithstanding the foregoing reserves TrotDirect or the right of the articles are not (fully) paid to take back.
Article 7 : Complaints
Any visible damage and / or quality shortcomings of an article or other failure in the delivery must be reported , under penalty of forfeiture of any right immediately.
Article 8: Guarantee
In order to invoke the warranty , the customer must provide proof of purchase .
For items purchased online and are delivered at the customer's home, the customer should contact the TrotDirect customer service. The customer that purchased the product shall deliver the goods at his expenses back to TrotDirect.
Any defect must be reported within 7 days after adoption. Afterwards, any right to repair or replacement is not promitted.
(Commercial and / or statutory ) warranty is not applicable to defects that arise as a result of accident , neglect , falls , abnormal or improper use , use of the product contrary to purpose for which it was designed , non-compliance with the instructions or manual adjustments or modifications to the article , rough use , poor maintenance , abnormal or improper use.
Neither does it apply to items with a shorter life , or wear items . Defects that manifest themselves after a period of 6 months from date of purchase or delivery , shall be deemed to be , no hidden defects subject to proof by the customer.
The warranty is not transferable .
The provisions of this Article shall apply only to customers who purchase items online in their capacity as consumers. The consumer has the right to announce TrotDirect that he renounces the purchase without penalty and without giving any reason within 14 days from the day following the delivery of the product . Customers wishing to make use of the right of withdrawal must contact within 14 days from the delivery TrotDirect and customer service to deliver the goods back to TrotDirect , within 20 days from delivery of the goods at their cost at Deerlijkseweg 68, 8790 Waregem, Belgium.
All goods must be returned to us by courier (DHL , DPD, Fedex , TNT, PostNL, ...). Only items that are in their original and undamaged packaging , along with all accessories, user manuals and invoice or proof of purchase can be returned .
Will in no case be reversed :
- Used , damaged, soiled , or incomplete items
- Products whose packaging ( or part of it ) was opened
- Items that can not be returned because of their nature
Article 10: Privacy
TrotDirect undertakes to use for the implementation of the concluded agreement you through your order terminating your information only and for you to send . Free information from TrotDirect Would you like to receive information via e - mail , please pass on your email address .
We treat your information as confidential and will never pass on , sell or rent to third parties. Article 14: Evidence
The customer accepts that electronic communications and backups can serve as evidence.
Article 15: Applicable law - Jurisdiction
The Belgian law is applicable except for the provisions of international law concerning applicable law and the Rome I Regulation on the International Sale of Goods . In case of disputes , the courts have exclusive jurisdiction in Belgium .
